DEFINITIONS

EAG shall mean "European Arc Guide Limited" and its successors in title.

End user shall mean "you", or the person(s) or company whose name appears on the EAG registration form and/or the EAG store checkout order receipt.

Registration shall mean that the end user has satisfactorily completed the online EAG registration form. Registered end users shall have limited access to the guide and software.

Access Fee shall mean a fee that is paid for the end user to access paid-for products and guide materials from the EAG store.

Renewal Fee shall mean the fee to be paid for continuous access to the products and guide materials from the EAG store on expiry of the access fee; expiry dates can be found on the end user's account page.

1. CONTRACT CONDITIONS

1.1 These Conditions shall be the conditions of contract. They shall prevail over any other conditions of contract.

1.2 European Arc Guide may modify its Terms and Conditions as needed. This could be, for example but not limited to, in compliance with new laws and regulations. These Terms and Conditions contract was last updated 26th September, 2021.

1.3 In the event of European Arc Guide modifying its Terms and Conditions, the date of the modification will be added to the above title (Section 1.2), users are expected to regularly check this at their own discretion; in the event that the user does no longer wish to comply with these conditions, they may request an expedited deletion of their account data as stated in the data privacy policy. In doing so the end user will waive their retention period.

2. PROPRIETARY RIGHTS

All content on this site, including but not limited to software, text, design, graphics, data, and any material submitted to the site are owned by European Arc Guide.

3. END USER CONDUCT

By using the EAG website, products and guide materials, you agree to:

• Not to disrupt or cause harm to; the site, resources, accounts, servers or networks.
• Not to transmit any harmful material through the site.
• Not to use nor attempt to access another user's account.
• Not to contact customer support with spam, junk, job adverts, goods, or services.
• Not to use any material found on the site as your own.

4. COMMUNICATIONS VIA THE SITE

You agree that any information sent to customer support becomes the property of European Arc Guide as stated in the Data Privacy Agreement.

5. ACCESS TO THE GUIDE AND SOFTWARE

5.1 Subject to the contract terms given here, end users will have individual access to the products/software and written guide materials based upon payment of the required access fee for a period of up to 12 months. This access will cease as shown by the expiration date displayed on the end user's account page; after which the end user will need to pay a renewal fee. Current renewal and access fees are displayed on the EAG website and can be found at: https://www.ea-guide.com/Store/StoreInfo.

5.2 Restrictions. As a condition of the registration and/or the granting of access to end users, you shall not attempt to, or allow the software to be decompiled, disassembled, or reverse engineered. Neither should you make any attempt to reconstruct source codes, underlying ideas, or methods.

5.3 Free access. EAG may grant free access to certain products or materials for specified periods of time. This will eb subject to registration of end users and subject to the provisions of these terms and conditions.

5.4 Third party access. Sole access will be granted to end users who have a valid registration for their sole use and will not be transferrable to third parties. End user accounts may be locked/suspended as a result of suspected third party use at EAG's discretion.

5.5 EAG discretion. European Arc Guide reserves the right to terminate user accounts at its own discretion.

5.6 Internet connection. The software will require an internet connection or other systems of electronic communications and these are the sole responsibility of the end user. An unstable internet connection may result in the inability to access the resource and materials as desired. An unstable internet connection may lead to issues during payment and processing, in these events section 6 is applied.

5.7 Compatible devices. The software is compatible with most phones, tablets, and personal computers but the end user is responsible for the configuration of their own devices.

6. PAYMENT

6.1 End users must pay the required fees upfront for access to the EAG products and other materials in the currency given on the EAG store at checkout. There is no further evaluation period and refunds will always be at the discretion of EAG.

6.2 Disputes. In the result of a payment dispute, EAG holds the final judgement.

7. CONTENT, PRODUCT, SERVICE - LIMITATIONS

All content created by the tools of the site is believed to be accurate. However, all users should independently evaluate the accuracy of the results. European Arc Guide does not guarantee that the tools will always produce 100% accurate results. Furthermore, European Arc Guide does not guarantee that the tools will always be available, in the event of maintenance the tools may become immediately unavailable without prior warning to the user.

8. LINKS AND THIRD-PARTY CONTENT

European Arc Guide will never post any links to external websites, all users should check where links within the site will take them, if the user is directed from the site to an infected site, European Arc Guide bears no responsibility to any damage that may be caused.

9. DISCLAIMERS

9.1 Any information and content provided on this site is subject to change, whilst European Arc Guide will not expressly try to change aspects of the site, as the tools and site continues to develop change is inevitable.

9.2 Due to the changing nature of the content and information provided by the site, European Arc Guide will have no liability for any damages or losses arising directly or indirectly as a result of any of the information accessible by the site not being accurate, complete, or up-to-date.

9.3 European Arc Guide will endeavour to minimise any downtime in the site's accessibility but since European Arc Guide does not directly control the servers used to host the site or the data/information held, European Arc Guide will have no liability whatsoever for any damages or losses arising directly or indirectly as a result of the user being unable to access the site or the user losing stored data.

10. LIMITATION OF LIABILITY

10.1 European Arc Guide will have no liability whatsoever for any death or personal injury arising out of use of the site.

10.2 European Arc Guide shall have no liability whatsoever for any loss whether direct, indirect, special, or consequential losses or damages of any loss of business, loss of opportunity, loss of sale, loss of data, loss of goodwill, loss of profits or anticipated savings, or increased costs regardless of how it arose.

11. LAW

By accessing or using this website, you specifically agree to submit to the personal and exclusive jurisdiction of England and Wales.

12. VALUE ADDED TAX

The access fee shall be increased as appropriate by the amount of any value added tax or other statutory fees which EAG or the Customer may be required to pay or reimburse in respect of the products or services supplied under the European Arc Guide.

13. WHOLE AGREEMENT

The End User acknowledges that the contract and these conditions contain the whole agreement between the parties and that the End User has not relied upon any oral or written representation made to the end user by EAG or its employees or agents and has made its own independent investigations into all matters relevant to it.
